This Privacy Policy describes how The Kitchen Cafe, LLC, its subsidiaries and affiliates, including The Kitchen, Hedge Row, Next Door, Upstairs and Kitchenette (collectively, the “Kitchen,” “we” or “our” or “us”), collect, use and disclose personal information about visitors to our websites (the “Sites”) and users of our online services.

Information We Collect and How We Use this Information

The Kitchen only collects personally identifiable information about individuals, such as name, email address and payment card when it is voluntarily provided. For example, you may be asked to provide your personal information in the following circumstances:

  • when you provide us with comments regarding a Kitchen restaurant, our Sites, or other aspects of The Kitchen;

  • when you register for our mailing lists or as a user of online or mobile products or services we offer, or to register for promotions or offers conducted through our Sites or mobile campaigns;

  • to transmit payment information for online or mobile orders;

  • to submit job inquiries and job applications; 

  • to submit other information to any of our Sites or through any of our mobile campaigns; and

  • to access complimentary WIFI in our restaurants.

Your information will be used for the purpose(s) for which you provide it. We may also use your information to communicate with you from time to time for other purposes, such as to create personalized promotions for you by combining your personal information with non-personal information about you, such as the amounts and types of purchases you make or the benefits you may receive through our programs.

We may also use information you provide to us for other purposes as described below, under “How We Share Your Information.”

In addition to personally identifiable information, The Kitchen may collect aggregated data or anonymized data that does not directly identify you. For example, we may automatically collect website usage information, such as information about your Internet service provider, your operating system, browser type, domain name, Internet protocol (IP) address, access times, the website that referred you to us, the Web pages you request, and the date and time of those requests.

Cookies, Web Beacons and Other Technologies

Like most Sites we use “cookies” which are small amounts of data that often include an anonymous unique identifier, which are stored on your computer and allow Sites to remember information about users. Cookies allow us to personalize your return visits to our Sites and to save you time during certain activities, such as checking out from our online store. 

You can use the options in your web browser to notify you when you receive a cookie or otherwise change your cookie preferences. Click on the "Help" section of your browser to learn how to make those changes. But remember, if you disable or delete cookies, you may not be able to take advantage of all features of our Sites.

How We Share Your Information 

We may share your information with our service providers, affiliates, partners, and other third parties as described below.

Third-Party Service Providers

We have third-party service providers, agents, franchisees, subsidiaries, and affiliates that perform functions on our behalf, including, but not limited to: hosting, online ordering and payment processing, reservations, content syndication, content management, technical integration, marketing, analytics, customer service, and fraud protection.

These entities may have access to your information if needed to perform services or functions on our behalf. If such access is required, the third parties will be contractually obligated to maintain the confidentiality and security of your personal information. The service providers are restricted from using, selling, or distributing this information in any way other than to provide the requested services and functions on our Sites.

Assignment

We may change our ownership or corporate organization while providing the Sites. We may also sell certain assets associated with the Sites. In such event, we may transfer some or all of your information to an entity acquiring all or part of our assets or to another entity with which we have merged. Under such circumstances, we will request the acquiring party to follow the practices described in this Privacy Policy, and you will be notified via email and/or a prominent notice on our website of any change in ownership or uses of your personally identifiable information, as well as any choices you may have regarding such information. 

Law Enforcement, Legal Process, and Emergency Situations

We may also use or disclose personally identifiable information if required to do so by law or based on our good-faith belief that such action is necessary to (a) conform to applicable law or comply with legal requirements; (b) protect and defend our rights or property, the Sites or our users, or (c) act to protect the personal safety of us, users of the Sites or the public.

How We Protect Your Information

We use commercially reasonable efforts to protect your information. While we try our best to safeguard the information you provide to us, no transmission of data over the Internet or any other public network is 100% secure.

Storing Your Information

The time period for which we keep your information varies according to what the information is used for and the purpose for which it was collected. In some cases, there are legal requirements to keep data for a minimum period. Unless there is a specific legal requirement for us to keep the information, we will retain it for no longer than is necessary for the purposes for which the data was collected or for which it is to be further used.  

Your Choices 

You may send us an email at realfood@thekitchen.com to request access to, correct, or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you do not want us to use your contact information to promote our restaurants, you can opt out by sending us an email stating your request to realfood@thekitchen.com . If you have received a promotional email from us, you can also opt out of receiving future promotional emails from us by following the unsubscribe instructions contained in such email.

Children’s Information

Our Sites are not intended for children under the age of 13. If we find out that we have collected information from or about a child under 13, we will immediately delete it.
